I agree. It is absolutely flabbersgasting to me that we don't have a nationwide voting process. Especially for nationwide elections! How is that justifiable?
And if any of you lawayers start spewing constitutional law at me, I'll vomit- that question was largely rhetorical.
I'm all for states' rights, but there are a number of things that I believe should be nationalized. Voting and licensure (fishing, driving, etc.) chief among them.

Not to risk inducing your vomit, but I don't believe there's actually anything to stop Congress from passing a law regulation the manner of elections (as Congress has done in designating the first Tuesday after the first Monday in November as a national Election Day). In particular, Article I, Section 4 of the Constitution says, basically, that the states get to decide the "times, places, and manner" of holding elections for federal positions, but that Congress can at any time make a law to alter those regulations. So in short, Congress should get their ass in the game and do something to standardize elections in this country as there's nothing stopping them from doing so (as least not in the Constitution).
ReplyDeleteThe Supreme Court (or at least Kennedy) seems to think that the Equal Protection is a restraint on state's voting powers (at least to elect Bush).
ReplyDeleteJust to be slightly clearer (i wasn't trying to make a clear point anyway), the Equal Protection clause would also apply to Congress.
ReplyDeleteSeems like Congress establishing standard ballots would be the definition of creating equal rights, not the denial of them.
